Kathleen Petrillo Quoted in "The Pink Sheet"   - In the April 11, 2008 issue of "The Pink Sheet," attorney Kathleen Petrillo comments on a recent court decision granting Teva Pharmaceuticals 180 days of market exclusivity for a generic version of the schizophrenia drug Risperdal (risperidone). Ms. Petrillo notes the decision is "extremely valuable" for Teva, and that Teva "had a good case."

PTO Considering Substantial Changes to Disclosure Requirements   - Senniger Powers attorney Andrew Wegman explains the U.S. Patent Office has published proposed rules regarding the requirements for submission of information to the Patent Office that would significantly increase the burden on patent applicants in many common situations. The proposed rules here were approved by the U.S. Office of Management and Budget on December 10, 2007.

Proposed USPTO Claims and Continuation Rules Rejected"   - A Virginia District Court rejected the USPTO's proposed rules on patent applications, stating that the rules are "in excess of statutory jurisdiction [and] authority." The proposed rules sought to limit the number of claims and number of "continuing applications" originating from a patent application.

Paul Fleischut Is Quoted on Patent Reform Legislation - Senniger Powers attorney Paul Fleischut discusses patent reform legislation in the January 28, 2008 issue of Chemical Week magazine. Mr. Fleischut says, "The impetus for the reform seems to be a desire to harmonize with the rest of the world and to simplify and eliminate litigation on the timing of one's invention." Two Senniger Attorneys Named Best Lawyers - Michael E. Godar and John K. Roedel, Jr. were among the seventeen attorneys included in St. Louis Magazine's annual listing of best intellectual property lawyers in St. Louis. Mr. Godar, former managing partner of Senniger Powers, has over 25 years of experience in the prosecution, licensing, and enforcement of patents and trademarks, particularly patents in the mechanical arts. Mr. Roedel has over 30 years of experience in chemical patent prosecution, litigation, counseling and opinions, due diligence, and antitrust. The February 2008 issue of St. Louis Magazine contains the listing of best lawyers in all practice areas.

U.S. Senate Judiciary Committee Approves Patent Law Reform Legislation - On January 14, 2008 the Committee issued a report urging the Senate to pass the Patent Reform Act of 2007 currently under consideration. The Act would fundamentally change the U.S. patent practice by converting it from a "first-to-invent" to a "first-to-file" system. The Act would also limit the manner in which compensatory damages may be calculated in infringement suits, and make procedural changes to the way patent lawsuits are pleaded and conducted. The bill will presumably be reconciled with a slightly different version which passed the House of Representatives last year by a close 220 to 175 margin. While the concept of reform has significant support in government and industry, the particular reforms under consideration have drawn substantial criticism. Debate in Congress is expected to be contentious, and passage is not a foregone conclusion.

Federal District Court Temporarily Blocks Implementation of New Patent Rules   - On October 31, 2007, the U.S. District Court for the Eastern District of Virginia temporarily enjoined the implementation of a new set of patent prosecution rules proposed by the U.S. Patent and Trademark Office (USPTO). The new rules, scheduled to become effective on November 1, 2007, would have placed substantial restrictions on patent applicants' ability to file Requests for Continued Examination and to pursue multiple patent claims.

International Trademark Association (INTA) Amends Model State Trademark Bill   - INTA has amended the Model State Trademark Bill (MSTB) to incorporate several significant changes included in the U.S. Trademark Dilution Revision Act (TDRA) of 2006. Senniger Powers attorney William O'Neill notes that "among the more important changes to the MSTB are a recognition of the TDRA's 'likely to cause dilution' standard and revised definitions of 'dilution by blurring' and 'dilution by tarnishment.' The MSTB also includes revised guidelines for proving 'fame'."

Senniger Powers' Julie Jennings Comments on Usenet.com Lawsuit   - Attorney Julie Jennings is quoted in The Register in an October 17, 2007 article, "RIAA Aims Lawyers at Usenet Newsgroup Service." The article discusses the recent lawsuit by fourteen recording companies, all members of the Recording Industry Association of America (RIAA), against Usenet.com. Jennings explains that RIAA is "accusing Usenet.com of direct copyright infringement, alleging that the service distributes and reproduces content without authorization. But they're also saying that the company induces others to infringe."

Julie Jennings Comments on Illegal Music Downloading   - Senniger Powers' Julie Jennings is quoted in a front page article in the October 8, 2007 issue of the St. Louis Post-Dispatch. The article, "Can't Stop the Music," discusses illegal music downloading and file-sharing. The issue has recently received national attention due to an October 4, 2007 federal jury decision that found a Minnesota woman liable for $222,000 in damages to six record companies for illegally downloading and sharing copyrighted music online. Ms. Jennings explains that despite the fact that "the copyright law does include penalties," sites allowing illegal free music sharing or downloading remain available.

Senniger Powers Announces Key Victory for MEMC Electronic Materials, Inc.   - Senniger Powers today announced a key victory for MEMC Electronic Materials, Inc., in an antitrust lawsuit filed by Sumitomo Mitsubishi Silicon Corporation (SUMCO) and SUMCO USA Corporation. The suit involved an attempted monopolization claim under § 2 of the Sherman Act. SUMCO sought $137 million in actual damages, treble damages, and attorneys’ fees. Senniger Powers partners David Harlan and Robert Evans, Jr., and Associates Marc Vander Tuig and Michael Hartley were involved in the case and were instrumental to its successful outcome. “We are gratified that the Court recognized that MEMC had a reasonable basis for its patent infringement lawsuit against SUMCO,” Partner David Harlan said.

Transclean Corp. v. Jiffy Lube International, Inc. et al.   -   As a general proposition, a patent owner is not required to sue all infringers at the same time, can pursue separate infringers successively in separate lawsuits, and can forego pursuing some infringers altogether. But as Senniger Powers attorney Nicholas Keppel explains, the Federal Circuit's decision handed down this month in Transclean Corp. v. Jiffy Lube International, Inc. et al. underscores that in certain situations, this may not hold true.

Companies are Losing out on IP Licensing Revenue   -   According to a recent licensing competitiveness study conducted by Pricewaterhouse Coopers, both large and small companies are finding it increasingly difficult to obtain all of the revenue they are due from their intellectual property licensing agreements. "Royalty leakage" can have several underlying causes, including ambiguous or ineffective language in the license agreement. Companies can help reduce the risk of lost revenue by carefully crafting the royalty provisions of the license agreement to spell out the obligations of both parties, according to SP attorney Julie Jennings.

U.S. Trademark Dilution Law Reform is Imminent   -   The Trademark Dilution Revision Act of 2006 (H.R. 683) recently passed both the U.S. House and Senate. The new bill will clarify, among other items, that dilution can occur "regardless of the presence or absence of actual, or likely confusion, competition or actual economic injury." According to Senniger Powers attorney Julie Jennings, clarification in this area of trademark law is much needed and will greatly assist trademark owners in defining and enforcing their rights.

Senniger Powers Clients Ingram Industries Inc., Lightning Source Inc. and Amazon.com Win Appeal at the Federal Circuit   -   On March 31, 2006, the United States Court of Appeals for the Federal Circuit ruled in favor of Senniger Powers clients Ingram Industries Inc., Lightning Source Inc., and Amazon.com, Inc. in a patent infringement case involving on-demand book printing. In reversing outright the trial court’s judgment, the Federal Circuit reversed five claim construction rulings of the trial court, agreeing on each issue with the position taken by Senniger Powers attorneys at trial. Senniger Powers counsel at trial and on appeal were Keith Rabenberg and Jennifer Hoekel. Lead appellate counsel was William West of Howrey Simon, Washington, DC.
