Firm Successfully Argues Case for Premier Election Solutions, Inc.
In a February 9, 2009 verdict in Avante International Technology Corporation v. Premier Election Solutions, Inc. et al., argued on behalf of Premier by Senniger Powers' Robert Evans, Jennifer Hoekel, and Sara Gillette, a federal jury in U.S. District Court found all of the asserted patent claims in Avante's U.S. Pat. Nos. 6,892,944 and 7,077,313 to be invalid. The jury also found that material prior art had been withheld from the U.S. Patent Office during prosecution of those patents. The patents covered certain optical ballot scanning systems. Robert Evans, who led the legal team, said of the jury verdict, "Premier is pleased with the outcome of the trial and the jury's support in reaffirming that the patent claims are invalid and that there has never been any infringement of those patent claims. The firm is very pleased with the result and satisfied that we could provide justice for Premier."
