Inventors Bernard Bilski and Rand Warsaw File a Petition for Writ of Certiorari

On January 28, 2009, inventors Bernard Bilski and Rand Warsaw filed a petition for writ of certiorari with the U.S. Supreme Court asking for review of the Federal Circuit's recent In re Bilski decision restating the standards which business methods must meet to be patentable. Meanwhile, the Bilski decision claimed an early casualty on January 22, 2009, as the U.S. District Court for the Central District of California declared U.S. Patent No. 6,292,788 (filed Sep. 18, 2001) relating to tax-deferred real estate exchanges to be invalid (Fort Properties, Inc., v. American Master Lease, LLC).
