Senniger Powers Wins Appeal for MEMC at the Federal Circuit

In Sumitomo Mitsubishi Silicon Corporation and SUMCO USA Corporation v. MEMC Electronic Materials, Inc., the United States Court of Appeals for the Federal Circuit affirmed summary judgment in favor of MEMC, confirming that MEMC had not violated the Sherman Act's prohibition against attempted monopolization. The case was appealed from the United States District Court for the Northern District of California. Robert Evans, Jr. argued on behalf of MEMC. With him on the brief were David Harlan and Marc Vander Tuig.
