Kathleen Petrillo Quoted in "The Pink Sheet"
In the April 11, 2008 issue of "The Pink Sheet," attorney Kathleen Petrillo comments on a recent court decision granting Teva Pharmaceuticals 180 days of market exclusivity for a generic version of the schizophrenia drug Risperdal (risperidone).
Teva was the first firm to file an Abbreviated New Drug Application (ANDA) with the FDA while the patent, owned by Johnson & Johnson, was still listed. Therefore, Ms. Petrillo notes, "I think Teva had a good case...The timing seems right for what Teva did. They were first in line." She adds that as more drugs lose patent protection, conflicts over generics are "likely to be a very active area of the law."
