Timothy McBride Discusses Roche Patent Lawsuit
Attorney Timothy McBride, in the March 2008 issue of IVD Technology, discusses a recent lawsuit filed by Roche Diagnostics alleging that several companies are infringing on two patents for electrochemical sensor technology in blood glucose monitoring.
McBride comments that the outcome of the case is uncertain and may result in a settlement, partly due to the costs involved in a lawsuit. "It's not likely Roche will be able to shut down all its competitors...If infringement looks to be the case, then generally, a license will result." He adds, "Even a very simple patent lawsuit on a very simple mechanical device could cost upwards of $1.5 million in legal fees alone."
