Kathleen Petrillo Quoted on Safe Harbor Provision - Attorney Kathleen Petrillo is quoted in the August 13, 2008 issue of Medical Devices Law & Industry Report in the article "Safe Harbor Does Not Protect a Device Not Subject to Agency Approval." Ms. Petrillo discusses a recent finding by the U.S. Court of Appeals for the Federal Circuit affirming that the safe harbor provision of the Hatch-Waxman Act does not apply in the case of Proveris Scientific Corp. v. Innovasystems Inc.

Partner Paul Fleischut Featured on CNN Radio - As attorney Paul Fleischut explains in an interview that aired on CNN Radio on July 29, 2008, the New York US District Court in Tiffany Inc. v. eBay, Inc. ruled on July 14 that even though 75% of all Tiffany-branded products sold on eBay are counterfeit, eBay's anti-counterfeiting safeguards satisfy its legal obligations. Under the law, Tiffany bears the ultimate burden of policing its trademark and protecting its brand.

David Crawford Nominated for Metropolitan Bar Caucus Committee   - Senniger Powers Attorney David Crawford's, president of the Bar Association of Metropolitan St. Louis (BAMSL), has been nominated as a candidate for a member-at-large slot on the Metropolitan Bar Caucus (MBC) Executive Committee. The MBC seeks to serve the interests and address the concerns of major metropolitan bar associations throughout the United States.

Supreme Court Rules in Quanta Computer v. LG Electronics   - In a unanimous decision written by Justice Clarence Thomas, the Supreme Court held that, as in its prior Univis decision, "method" patent rights may be exhausted under circumstances that exhaust corresponding "product" patent rights. Elizabeth Millard Wins AIPLA Award - Elizabeth Millard received the 2007 American Intellectual Property Association (AIPLA) Past President's Award for her paper titled "Injunctive Relief in Patent Cases: Should Courts Apply a Rebuttable Presumption of Irreparable Harm After e-Bay?" Ms. Millard is a former summer associate at Senniger Powers and will join the firm in September after her graduation from St. Louis University Law School.

Kathleen Petrillo Quoted in "The Pink Sheet"   - In the April 11, 2008 issue of "The Pink Sheet," attorney Kathleen Petrillo comments on a recent court decision granting Teva Pharmaceuticals 180 days of market exclusivity for a generic version of the schizophrenia drug Risperdal (risperidone). Ms. Petrillo notes the decision is "extremely valuable" for Teva, and that Teva "had a good case."
