Jan Hendrickson to Speak on Therasense
On June 29, 2011, Jan Hendrickson, Ph.D., will speak on Therasense: Reviewing the Inequitable Conduct Doctrine. Dr. Hendrickson will discuss the Federal Circuit's decision in Therasense, Inc. v. Becton, Dickinson and Co. The Court reviewed the standards for materiality, intent, and balancing for inequitable conduct. Questions that were considered included the materiality-intent-balancing framework, the standard for materiality, when intent could be inferred from materiality, and whether standards for materiality and intent from other agencies or the common law should be considered. The case history, policy considerations, and arguments will be discussed and guidance for prosecutors and litigators will be provided.
Dr. Hendrickson specializes in patent related issues, including the development, management, and enforcement of worldwide patent portfolios.
